Rental Policy

 

 OWNERSHIP OF PROPERTY: Owner warrants that the Property leases under this Rental Agreement are Owner’s sole and exclusive property. Renter shall have no right or interest in such property except as expressly set forth in this Rental Agreement.


 
RENTER’S INSPECTION AND ACCEPTANCE: Renter acknowledges that he has inspected every item of property delivered pursuant to this Rental Agreement, that all items are in good condition, and that Renter has accepted such Property in good operating condition.

 
RETURN OF THE PROPERTY: Prior to the expiration of termination of this Rental Agreement, Renter agrees to return to Owner of the Property leased, in as good condition as it was when delivered to Renter, ordinary wear and tear resulting from proper use alone excepted, and free from all liens and encumbrances, to Owner’s address as set forth above. If Renter violates any term of this Rental Agreement, Owner shall have the right to enter upon any premises where the property may be found and take possession of and remove the property without incurring any liability relating to the taking of possession or of removal.

 
NO WARRANTIES: Owner does not make any warranties, expressed or implied, nor shall any warranties arise by operation of law, as to the Property leased, including but not limited to fitness for any particular use, merchantability, design, capacity, or performance. If in the event of any claim concerning the use of the property leased or any other claim concerning the Property, regardless of cause or consequence, Renter’s only remedy, if any shall be against the seller or manufacturer of the Property. RENTER HEREBY WAIVES ANY AND ALL WARRANTIES AND CLAIMS AGAINST THE OWNER, EXPRESSED OR IMPLIED, IN FACT OR IMPLIED IN LAW. Liability and responsibility for personal injuries or death of any person in connection with the use, operation of, or transportation of the Property, or any item thereof, shall be borne by Renter.

 
LOSS OR DAMAGE: Renter assumes all risks of damage to the Property from any cause and agrees to pay to the owner the fair market value of the Property or repair the Property to its condition at the time of execution of the Rental Agreement. Renter will not attempt to repair the Property under any circumstance and will notify the Owner of damage incurred before or after the Rental Agreement has been executed. No loss of or damage to the Property shall impair any obligation of Renter under this Rental Agreement, including the payment of rentals. The owner of the Rental Property shall have the right to collect monies owed by any means necessary including but not limited to charging the renters credit card (whether customer is present or not) for any loss or damages incurred to the Rental Property.

 
ATTORNEY’S FEES: In the event renter breeches any term, condition, or obligation hereof, Renter agrees to pay all reasonable expenses, cost and attorney’s fees to Owner in connection with the enforcement of this lease.

 
This Rental Agreement constitutes the entire agreement between the parties. This Rental Agreement shall not be amended except by written agreement signed by both parties. The laws of the State of North Carolina and of South Carolina shall govern this Rental Agreement.

 
*Please notify us immediately of inoperative equipment or you will be charged a full day’s rental for every day not returned.

 
ADDITIONAL CHARGES ON RETURN:
*Replacement of cut power cord: $65.00

 
*Cleaning Charges: $75 per hour

 
REPAIR CHARGES: $75 per hour will be charged if the Property is returned damaged. This charge does not include replacement costs of parts and applicable taxes.
